IPR protection & Mapping Brand Infringement for an Environmental Technology Company in China
A Swedish manufacturer of products in the environmental technology sector had become aware of infringements occurring in the aftersales market of its products in China.
Asia Perspective was contacted by the client to support in identifying infringing actors in China in order to protect the interests of the company. 92 suppliers in 8 provinces producing similar products as the client was contacted and investigated by Asia Perspective.
As a result of the research, eight suppliers were identified as suspected suppliers based on received quotations and pictures of the products. Asia Perspective provided the name and information of the suspected suppliers along with the specific locations and recommended actions regarding the protection of the client’s Intellectual Property Rights in China.
A Swedish manufacturer of products in the environmental technology sector with established sales channels spreading over 50 countries had become aware of infringements occurring in the aftersales market in China.
The client had identified products and spare parts being copied and sold at a lower price by third party companies without authorization.
The client was concerned about the negative impacts of the company’s business both in the short term as well as in the long term. As a result, Asia Perspective was contacted by the client to assist in identifying infringing actions and locating the third party companies in China.
Asia Perspective started the project by establishing the selection criteria of the suppliers along with the methodology to follow:
In total, the project included a detailed analysis and screening of 92 suppliers producing similar products as the client in various locations in China.
Based on the information collected from the in-depth screening, Asia Perspective identified eight suspected suppliers having similar product design and name as the client.
In addition to the suppliers’ background information such as company name, location along with quotations and pictures of the copied products, recommended legal actions were outlined in order to increase the protection of the client’s Intellectual Property Rights on the Chinese market.
The analysis and information provided by Asia Perspective including detailed mapping and recommended actions, allowed the client to implement the necessary protective actions on the Chinese market and outline a strategy of protection in terms of intellectual property rights in China.
Following the report provided by Asia Perspective, the client was able to directly contact the related platforms and request the websites to delete the copied products and related information of the client.
Based on the collected information and evidence in the report, the client also had sufficient material from suspected suppliers to consult an Intellectual Property Rights lawyer in China regarding the potential legal actions of the brand infringement.
